“Effective Oct. 1, 2006, Sprint will charge $0.15 per message for casual domestic and international text messages sent or received.
Sprint will charge $0.03/KB for casual data usage.”
According to Sprint’s terms and condition:
“If we change a material term of the Agreement and that change has a material adverse effect on you, you may terminate the Agreement without an early termination fee by calling 1-888-211-4727 within 30 days after
the invoice date of the first invoice you receive after the changes go into effect.”
I told my friend about this and he was successfully able to cancel his contract with Sprint without paying the early termination fee (ETF) while he still had 2 year to go on contract. You need to call Sprint before you pay your bill. If you pay your bill, you are “agreeing” to these new terms.
Surprisingly it works. I had to call two times before succeeding. The first representative I talked to was no luck and simply would not change his mind. I called again and was in luck after some arguements. I hate sprint.

You need to avoid the one that first posted that disclaimer, But If I were you, I would still give them a call for this month and try to cancel your service. Also, some people do not recieve their bill in mail because they pay it online. So, just give them a call and see what they say. If they say no, call them again until you have success.
If you have unlimited txt messaging part on your plan then this does not affect you. If you have like 500 free txt messaging, then you should have a good excuse to why you qualify for cancelling the contract.

Stop flooding on here. Send a txt message from another phone to your phone and then tell them “this does affect me because I just got charged more.’”
Since you got different answers for each call, then keep calling until you are in luck.
Ok, I got my physical bill in the mail today for Aug 24 cycle. I refuse to have auto payment or electronic billing because Sprint sneaks these things in sometimes. It took 4 months and 3 CSRs to get charges fixed from when we added my sister to our plan. Sprint is great other than the CSRs being inconsistent.
Aside from that, the message to me was confusing because I didn’t know what “casual” texting is, but I am now assuming it means “someone without a texting package.” Do any of you think that? I pay $7.50/mo for unlim texting. My husband “casually” texts and pays per text. I assume this is where the change takes affect, his bills will have charges of .15 cents per text instead of .10 cents as before. Does that make sense?
I called sprint and got transfered to a nice lady. I told her I want to cancel my sprint contract without the ETF because of their terms as per their agreement. I was nice to her but she had no idea what I was talking about. We talked on for few minutes then I asked to talk to a supervisor, and she TOLD me she was a supervisor! Yeah… right. I still remained calm and talked nicely. After few conversation, she put me on hold and came back after two minutes. She said I was out of contract and would not have to pay ETF.
My service will work until the next bill. I was planning on cancelling sprint anyways!
This works. I had to call twice, the first lady refused to listen to me and confirmed everything I hate about sprint. The second girl was very nice and had obviously been dealing with people exploiting this loophole, as she knew what I was getting at and tried to bribe me into staying (Free text messaging and a new phone). They will try to tell you that the change does not affect you because you have a text messaging package. If they tell you that the loophole doesn’t affect you because you have X amount of text messages per month stay cool and tell them that if you send X+1 messages it will affect you and that qualifies you.
It really does work. Thanks for the information. It was helpful in dealing with them. They are quite stubborn, but if you’re willing to deal with it (have the patience for it) then you can get it done. Anyway, I just wanted to say thank you to all of you for this useful information.

I told them that is just dumb because how does a price increase affect users who already have text messaging plan since they pay a fixed price for txt messages. Example: 500 txt messages for $10. This won’t affects them.
They offered me good deals and upgrades but I just wanted to cancel my contract. I told them I will have to file a complain in Better Business Bureau. They still refused but after a while they gave up. I even called back later to make sure they had cancelled my contract and they did do it! I am free!
I got no where until I talked to the supervisor. Worked like a charm. I was polite and kept using the broken record technique. He allowed me to cancel with no ETFee.
Works like a charm, but one guy was telling me that he offered me 500 free email minutes, and that he didn’t have to abide by the statement. Keep telling him he’s wrong, because he was and I ended up getting it after talking to someone else.
This absolutely works. Dont let them tell you you cant do it. I got quite a few excuses, and simply, calmly stated that all the statements she told me made sense, but that still isnt what was stated in the agreement.
The CSR attempted to tell me that since I didnt have a text messaging plan, it doesnt apply to me, because using text messages is optional I then asked “what if someone SENDS me a message?” At which point i asked for a supervisor, and they canceled the account.

Dee, make sure they placed a note on your account so you won’t have any hassles later when you call back to cancel. Be persistent if they deny after sept. 24. Good luck.
Do I need to call 1-888-211-4727 to cancel in order to follow the exact terminology of the agreement? Because I want to port my number to a new carrier. I’m afraid porting the number will automatically cancel the contract with sprint and that they will charge me the ETF. What should I do?
Yea, eddie, call that number and tell them you want to cancel. Once they cancel, the sprint service will work until your next billing cycle. So I recommend contacting the new company once Sprint has agreed to cancel the account without any early termination fee.
Also, ask the Sprint Representative after they cancel if you will be charged ETF to port your number if you do it before the next/last billing cycle.
WOW!! This was a lifesaver. We have HORRIBLE Sprint service at our new house and we have tried unsuccesfully for months to cancel without EFTs. I called and cited this loophole and the cancelled with NO EFTs. Absoulutely AWESOME! Of cource they himhawed around and tried to get me to stay with more free text messeging, Then they put me on hold for 15 minutes, etc..but eventually they had no where else to run and caved. Thanks!
Worked like a charm. The lady claimed that the change took effect Sept. 1. I argued and quoted the bill. She put me on hold while she checked. She said that I was “absolutely right” and wanted to know why I wanted to cancel. I told her that texting was going to be tooexpensive. She said that they could match any offer I got. I told her that I wanted to switch because i didn’t want to be with Sprint and I had family members on another network. She said fine. I realized that I had to transfer my number so I had her put a note on my account until I could transfer my number and call back and cancel with NO FEES! Thanks for the tip!
I have not recieved a physical bill from sprint in about over a year…I want to cancel with them using the text messaging loopwhole. How should I go about doing this?

Sign in to your Sprint PCS account online and look for online version of the bills. They have the same message on there as on the physical bill.
It is even listed on one of your Online Account page when you sign in. I have seen it online just two days ago.

This DOES still work. I just terminated my account TODAY with no ETF (early termination fee.)
The only difference is the CSRs and the Floor Supervisors are more tenacious than ever. They will tell you again and again that “you can close the account, but there WILL be a fee.” They will even refer you to their legal department.
To succeed with Sprint, your strategy should be as follows (this is what worked for me.)
1. Go into broken record mode. Say, repeatedly, “according to the Terms and Conditions, I have the right to terminate my contract with no termination fee if Sprint changes its rate plan. The Terms and Conditions do not specify that Sprint can force me to waive this right by offering me anything for free, nor do I want anything for free. I want to cancel my account, as is my right under the terms and conditions.” Be prepared to say that the SMS messages will cost you 15 cents, and that even if you have the 500 SMS plan, on SMS number 501 you will be charged 15 cents. As a poster to this thread wrote, very wisely–the clause in Terms and Conditions does NOT specify what ‘material adverse effect’ is, nor does it say Sprint may foreclose this right by offering you anything for free. Keep saying it–they have a record of how long the phone conversation is, and if they see you have been on the phone for an hour, you will get some supervisor attention. Keep them on the phone as long as possible.
2. Then, extract concessions from them. They offered me unlimited SMS and data for the life of my plan, plus 300 minutes per month for 30$, plus nights and weekends starting at 8pm, plus an extra 400 minutes and 35$ credit for my troubles.
3. Repeat. As in, after doing the above, I just hung up and called again (use this line 888 567 5528.) They will give you more and more concessions each time you call. Ask to be credited for your time (a few hundred minutes or 10$ credits here and there.)
4. Ask where they are calling from. THE CALL SITES MOST LIKELY TO WAIVE YOUR ETF ARE IN CENTRAL FLORIDA OR ORLANDO. Stay calm, and demonstrate your willingess to hang up on them after getting a concession like a better plan, and hang right up and call again!!!
5. Do not be afraid to LIE. They certainly lie like crazy to get out of their contractual obligations. For example, if you extended your 2 year contract on the phone with them, just say “NO-I NEVER said that i agreed to extend my contract. The rep on the phone EXPLICITLY told me that i WOULD NOT be extending my contract.”
To conclude, your objective is to call, extract concessions (by keeping them on the phone as long as possible so the supervisor is incentivized to get you off the phone by any means possible because they need to maximize call volume/turnover), and repeat. BE PERSISTENT–THEY LIED THROUGH THEIR TEETH TO ME. They’d rather refer you to legal than give in to what it CLEARLY states in the terms and conditions.
And lastly– DO NOT PAY YOUR BILL. According to terms and conditions, paying your bill signifies acceptance of the new charges. But deifnitely still call and badger them repeatedly (on the weekend works well because of the free calls)– they *will* MASSIVELY upgrade your plan, which might give you what you wanted in the first place. But monitor your bill, because they might offer you sth for free, then try to charge you for it.
GOOD LUCK SCREWING THIS EVIL COMPANY!
This is a matter of principle, a David and Goliath struggle against a powerful company competing in what is basically an oligopoly with very, very anti-consumer characteristics of the industry. Take a principled stand! This company’s share price should eventually reflect their dishonesty and skewed incentives given to employees at the call centers, the frontline in interfacing with customers. What Sprint is doing is WRONG, and you can be part of the problem or part of the solution. Injustice anywhere is a threat to justice everywhere. Let’s keep this thread going, and stand together to generate strategies for opposing this nasty behemoth. Who knows, we might generate critical mass to launch an effective lawsuit one of these days and bring down SPRINT once and for all!!!!!

Bascically, if you still use your phone, you’re agreeing to the change in the agreement. I called, argued with a very polite CSR and a very tenacious Floor Supervisor for no less than 30 minutes. I didn’t get to cancel. Terms and conditions clearly state the events in which you are able to cancel without an ETF, but it also clearly states (as above) that using their services constitutes agreement.
I just recieved info over at my sprint forum from a sprint customer service supervisor that this little trick was “worked around.” I guess too many people found out about it and now sprints lawyers tell them this isn’t the case and they can hold you to the fee.

I got my depsoit back earlier in the month and it was not even the full amount. I spent a couple of hours on the phone with those “bastards” at SPRINT and they all just gave me the run around telling me the same shit.that the international messaging rates dont aply to me because I never text anyone internationaly.
This really does work. I’d highly recommend calling the 888-567-5528 number. You get in directly with an agent either in orlando or central florida. I tried calling the main number and being transferred over and over, offered concessions, the whole nine yards. I called this number, and within 10 minutes the account was closed, no early termination fee, and my number was ported that night to my new cellular phone provider. I was very pleased.
Don’t give up!! If you don’t get what you want call again! It took me nearly 2 hours and three separate phone calls but I did get it.

Yes this Does work, took me 4 calls to finally get someone to do it and I dont have to pay my termination fee. My adive is just keep calling the 888-567-5528 Direct Line, if someone says no argue with them for about 5 minutes and if they dont give in call back and try someone else. Like I said the 4th person I talked to finally gave in. THERE IS NO SPRINT CUSTOMER THAT IS NOT AFFECTED BY THIS, DONT LET THEM TELL YOU OTHERWISE, They told me that because I had a text package that I wasnt affected and i argued that if i go over my alotted text amount that i will be affected by it.
Just keep trying and it will eventually work.
1st attempt to cancel my subscription. I have a plan with 1000 text msgs and I went over my plan the previous month by 15 msgs. First I talked to a CSR who said it wouldn’t affect me because I have an existing plan and will remain at 10 cents. Asked for a Super…told me it would be 15 cents. Transferred to retention grp…told it would be 15 but could offer unlimited text msgs for same price. Asked for sup…told it would be 10 and. Talked to four people total (2 CSR/2 Sup) and they all said I couldn’t cancel w/o paying the ETF. Although they did tell me different termination fees.
I was told I could terminate, but since that doesn’t do me any good (family plan, with the main line not ever texting so I couldn’t cancel it) I was able to get unlimited text for 2 years on all 4 phones on my plan… or at least until I cancel next august! 1st CSR told me it didn’t apply. 2nd one was very friendly and helpful.
stop trying to use loopholes is causing other peoples phone servie to go up. stop being cry babies. no one forced you to sign up, and you got a rebate when you got the phone. look i work at sprint and this whole entire web site is wrong. 1st in KMS the officail documnet of sprint. it states that if a customer is currently on a text plan they are grandfathered and the rates wont change. therefore it is not a violation of the contract and the ETF will not be waived. However, causual user (those wihtout a plan) rate will go up. It goes on to state that if the customer isnt using text messages then we will not waive the fee eithher. If is a legitimate case, meaning customer has been using text messages on a causual usage (per text without plan) we can waive the fee. ANd no 1 or 2 text messages doesnt count. However to combat being abused, we are now giving the customer the text messaging. therfore there is no breach of contract. basically, closing any “loophole”. the customer cannot complain that their text mesage rate is changing from 10 to 15 cents but if we give it for free that we are still in a breach.
plus we have the best phones!!
Bill — that’s mostly right. KMS says it should stay the same — but in actuality the only thing that stays the same is the cost of the text message plans. The casual rate goes up regardless of when you signed your contract. Grandfather clause only applies to the cost of the plan itself… not the casual rate charge. I dealt with customers all night tonight who called about their overage on text plan that charged them. Even people that have the old text plans (pre Aug 06) - if you go over it’s still $.15 each.

basically macking unlited texting for free and walla, no more leg to stand on for all those would be lawyers out there! note to get the “z free sms 2yr” you have to change the date to 08/01/2006 before searching for it in p2k since it really is a historical plan.
everyone it is true. i got 3 lines cancelled today under that clause from the t&c’s for sprint. and if you have text messaging unlimited, it just needs to be removed prior to you asking for the cancellation fees to be waived. Also, if you are looking for a good cell phone carrier that is RELIABLE and good. go with verizon, i know over 15 people that went from Sprint to Verizon and can’t stop talking about it

Honsetly, being a sprint operator I am saying no to all request to waive etf. ALL cell phone companies periodically have small rate changes. the only thing that happend here was the cnn on monday night aired a big special. Normally we have like 1 or 2 people calling in trying to use some loophole. but because of the tv “special” everyone decided they were a lawyer and called in.
You can try and take any legal loophole to an extreme. Let us know the real reason you want to cancil. i had some lady using the text message loophole for an hour. then i fianlly found out she was upset becasue to get 7pm night and weekneds she had to renew her contrat. i gave her the new plan without renewing the contract. if it is resonable we will accomidate you. if you just break your phone every couple of months and always want a new one then come on. We actually will waive the etf fee on some peole because there plan is so small and they call us too much and ask for too much credits that technically wed be better of if they left. When i offer to waive the etf i get, no alot of times!! BEcasue they have called and got so many free bees on their account it is silly. we will give you something to make you feel specail so you dont cancil. that the probles now a days everyone has to be so speacial.
This worked for me for one of my two lines. Today I got the woman to waive the ETF for one of my phones because of the text messaging rate increase, but she wouldn’t do it for the second phone since I have never used text messaging on that phone before. I may have been able to argue it more, but I figure I’d cut my losses and paying $150 is much better than paying $300.
A few things to think about, they told me if I want to port my numbers to a new carrier, I have to start the new contract first, then the new carrier will notify Sprint of my cancellation with them. This means today I have to believe the woman I spoke to when she said she wrote in my account notes for them to waive one of my fees. I just gotta believe them, which is taking a chance, but I am doing it. I hate Sprint soooo much!
Also—-this whole thing may not work if you have used your text messaging since the rate increase. Using it means you agree to the new rates. Luckily I have not used it since October 1.
By the way, they did not offer me any perks or anything. The only thing they tried to get me on was that my one phone has the web option for text messaging (not pay per message) so they said it didn’t apply. But the rate per KB also went up, so it actually does apply. Be prepared to defend your case and know what you are saying, and be persistent.
Called Nextel twice, they said since I have a Blackberry with a data plan text messaging charges don’t apply to me. Both CSR refused to transfer me to a manager. Next stop, BBB.
Umm,,, first of all if we add the code “Early term reup” on your account to wavie the Etf fee it has a 30 day range. if you port you will get charged the fee!! for example lets say your biling cycle if the oct 1st to the oct 3oth, you call up on, say the oct 15th, the code we put on to waive the fee has a date range of 30 days only. so it will be from oct 15 to nov 15. since the bill print out on oct 3oth and that is between the date range of the waiver code no etf fee applies. however lets say you port out on oct 19, if cancils or trims back all the dates. so the waiver code now will only have a date range of oct 15 to oct 19th. thus when the bill hits on oct 30th you will actually will be charged the 150$. you either have to just get a new number. or you will get charge and will have to call back and convince someone to give you a manuel credit. Our legal department is telling us to on a case by case basis waive or not waive the etf fee. yes they gave us a chart. if the custoerm has a phone that cant text message no waiver, if the customer is on a text plan no waiver. if the customer isnt using text messages no waiver. and no we actually have a code to give free text messaging pretty much making a reat hike mute. obviously, if you call in a million times you eventually will get it done. that like any other bussiness. i had 800 in over draft fees at my bank. i had to call a million times before o got them waived. let me know if any one out here actually has a real problem i could give you advice on how to get it solved. because even if you cancil yopu have to go to another provider and pay an activvation fee and guess what sign onther 2 year agreement. back in the same boat. and we just got confiamtion that we are getting more new motoral phones.

The Special aired Friday night on the west coast and will air on the east coast tonight. I have already received two calls.
Apparently, when customers signed up prior to the Nextel/Sprint Merger are logo was red. Now that the logo is yellow
the lawyers fell that this is misleading. Not all customers like yellow. Therefore, our legal time has made the following as a guide when to waive the ETF fee.
1. if a customer calls in and states he wants the ETF waived due to the “color logo loophole” ask the following questions:
a. Do you like apples or lemons?
b. What color is your car?
Customers answering apples and have a red car waive the ETF.
Customer answering lemons and a yellow car are lying so don’t waive the ETF.
Any combination besides the above will get an ETF fee waiver
just kidding!!!!!!!
To all of you who tried and got a NO for answer, my advice is to keep calling; it took me 5 calls, 2 hours and a lot of patience.
Also remember that Sprint is now charging $0.03 for PCS data usage. You have to check your invoices and look for additional charges that they did to your account for PCS data. in my case they charged me 18 cents for PCS data usage last month, so this means that YES, this change has a material adverse effect on me
That is the argument that finally set me free from the worst mobile company in this country.
keep in mind accout services has both codes to give free internet and free texting. dude if we give those for free, there in no adverse effect, how brian dead are you? we are giving permission to waive complainers fee beacsue overall they cost more money than there worth. sorry to bust your bubble 18 cents is not a material breach becuase we can credit you the 18 cents dumbass!! people did this before the reate hike, they just caled and complained about their coverage and hours and we let then go. you havnt discovered anything new. and abviusly if it took you two hours and 5 calls its the ploicy but someone getting tired of listening to you wine.

I want to say that even though the fee was waived, I got a bill with it on it. However one call to the 888-567-5528 I got the best customer service reps there. If you can ask for Derek or Monica his supervisor. Both are in the orlando call center. I did manage to get everything resolved, my bill is paid up and I have a zero balance. The text messaging was a loophole however, the lack of service in my area, was the kicker. Thank you to everyone here. You guys really helped and you rock!
OK HERE IS THE DEAL:
It took me 2 tries to get it cancel.
1. Before you call in make sure that you send and receive ALOT of text message. I would do for a day prior to calling.
2. You only reason for calling is because of the text message increase and per the agreement above you wish to cancel. Do not talk about bad service at all.
3. If you paid your bill say that you have bill pay w/ your bank account and it takes time to cancel.
The bank account thing might work, but if not stay calm. If they offer you something and its not to cancel after about 10 mintues say you will think about it wait a 1 hr and call back.
Stay calm and if the first time you don’t get it just be persistance. Just make sure you using text message. BTW may Sprint service @ work, home, and home town sucks. I HATE SPRINT GOOD LUCK!
I called yesterday about this and didn’t have any luck. They said since I have the Text messaging plan that it doesn’t affect me. Even if I went over my 300 minutes the 301 text would be 10 cents still. Or so they say…
Also for the casual data usage going up .01 can I call and complain about that? Will that be a breach of contract?
Nobody is telling the full story. just becasue their is a change in a contract. does not mean that the customer automatically has a breach. the custeor has to be “adversly effected” in addition sprint now has codes that can grandfather you in, technically making it cheaper than before the hike! for example most people calling are being offerted free text messages for free. ons sprint offers it for free there is no longer any so called breach. can you imaging suing in court because you were originally paying 10 cents but now sprint offered it for free and you now are upset because its o cents. that like saying if a credit card company lowered its late fee from 20$ to 0$ its still a breach!! now wiyth that sad if you repeativly call in over and over agian, most likly you will get your way. the operators now are getting more aware of the calls. but its statrted to get lower and lower sussess rates. Bill, you are a moron. The contract (”Terms and Conditions”) does not say that the customer’s right to have the ETF waived is foreclosed because Sprint gives her something for free. It merely says that if there is a change, customer can cancel with no ETF. As for “material adverse change,” having to call is itself such an annoying and time consuming procedure that it amounts to a MAC. Finally, Sprint does NOT offer free data usage, which is also affected by the rate hike.
In short, Bill is clearly both a Sprint employee/service rep, and just like 90 percent of the reps that the people on this site have had contact with, is a complete idiot. There is nothing funnier (or frustrating) than hearing a semi-literate trained monkey trying to debate the terms of law and contracts.

making any future claims nullified. now every time there is a future change will will have a granfathered code a week in advance. so we will not have to waive the etf fee. Yes i stand buy the morally stealing. i had a custoemr who canciled 30 lines due to the so called text message loophole, then went out and got 30 more phones and tried to get the new contract canciled. bascially selling the ohter phones. First of all if you want to debate law lets debate. you can take any legal principle to an extreme. as far as to what a “adverse affect” would be, generaly speaking this would not apply to people who have not used text messages or where on a text message plan. now you may have a case that you wre going to incresase you usage in the future.
But this would be up to a court to decided if there was a breach. most companies do not like bad press or the hassle and will give in to consumer demind. It doesnt mean that the consumer that got the etf fee waived had any legal standing or would have won in court. Cell phone custoerm on general with all providers tend to have a love hate relationship with their provider. it is due to the hyper competitive environment in the cell phnone industry, their is always a constant feeling that, “i am trapped”, or there is a better deal acreoss the street, or dammit i want that new phone and i just bought a phone and i cant return it. Generally speaking most people would say that getting out of a contrract by using a loophile is dishonest. you can justify this I guess by saying the company did you wrong. but mostly its to get that new phone.
the legal principles in this deabte or just bacis contract law that any one who took a low level college class should be able to figure out. Its simple, CBS have a big story and now every time any cell phone company makes a change they better be ready with a code to add to grandfather customers in.
ETF fee for TXT/Vision rate increases- If a customer is wanting to terminate service due to this we should be making a first effort as with all issues to get the customer on a package of services that fit their need.
If they are still unsatisfied then we should transfer to Account Services/BAR. Marketing has added a new code for BAR “Z DATA OVG FIX” that returns the customer to the original rates. This should be communicated soon.
This is a temporary flag code that will be available till 10/28 when new permanent codes will be created for them. Since they will be reverted back to the original rates this nullifies the rate increase for them. We are also researching if customers with the Grandfather Vision code were or were not affected by the rate increase.

Sprint is evil because its business plan “preys upon the weak”–working people who can least afford to take time off from work and caring for their families to spend hours arguing with and being placed on hold by inane CSRs, and probably people least able (because of levels of English language ability, legal-minded sophistication, knowledge of alternatives and combat strategies) to effectively defend themselves. People who most need to defend their credit history. The world will be a better place when Sprint is gone. And your own executives know this, which is why they’re bailing like rats from a sinking ship.
Bill, if you confess and admit Sprint’s evil sins and expose their evil ways and come to terms with your participation, I will personally help you with your job search once Sprint downsizes you, or when Sprint is (hopefully) liquidated under Chapter 7 or 11 in the next few months.
Luke I am your father, come over to the sprint side it has power great power. we will take over the world by trapping people into contracts, millions of them. then when they are least expecting it we will raise the text message rate form 10 to 15 cents! wa ha ha ha ha (dracula like laugh). Without debating the legality of the situation, it’s unfortunate that so many are willing to debate the effect of service charges that don’t appear to be affecting a majority of the people using the right to waive the ETF. That’s the definition of a loophole, and it’s generally (with some exceptions) not an upstanding person that will take advantage of it.
The margins on cellular service are slim and carriers do what they can to attract new customers. It’s easier to market and influence new customers in an industry that’s inherently difficult to please existing customers. Who is at fault here, Sprint or the phone manufacturers that charge such outrageous prices for a phone that few people will buy without the carrier subsidizing it? Or both?
Taking advantage of the loophole that currently exists is not an open and shut case, and the CSRs who have posted here are just as “right” as the opposition when common sense is involved, not written law.
I would LOVE to have my EFT waived because I just signed up with Sprint in July and hate my current phone and want to return to BlackBerry land, but the 8703 is $250 more expensive than if I was a new customer again. It will be cheaper to cancel my contract, pay the EFT and sign up as a new account. THAT’S where I lose the logic in phone subsidies. And I won’t use a loophole to do it.

Here are the official notes. BAR supervisors could you please make sure the floor walkers are aware of this since there is not distribution list that I know of for them.
FYI: There is one important clarification for BAR. There are 2 “Z” codes to change the overage rates for data and text to the old rates. “Z Data OVG Fix” and “Z 2way SM .10”. During the call we were told the text code would not be available till after the 28th and to use the data code but as it mentions in the official notes this info looks to have been incorrect. Enclosed below is the new KMS solution that makes it official, use the Z codes to save the customer and if they still are requesting to cancel they WILL be responsible for the ETF.
There is also one contradicting statement in the partnering call notes. They indicate that account services does not need to use the lost/stolen disposition for a cancellation if the customer is canceling less than 30 days after activation and to look at the KMS solution, but, the proposed KMS document still says you should do this. I will request clarification.

· Recent communications sent by third-parties and posted in certain media outlets have made erroneous statements to the effect that this pricing change on casual text messaging and casual data service triggers the right of all current Sprint customers to terminate contracts with Sprint without being subject to the Early Termination Fee (ETF) charge.
· Sprint reserves the right to change its prices from time to time and has instituted guidelines to address customer concerns that may arise.
· General Care will make sure the customer understands whether he or she is impacted by the increase.
· General Care reminds customers that written notice was sent to them in advance. They may also issue that customer a full credit to cover the pricing increase charges to date, where appropriate.
· They will discuss options with the customer to subscribe to any of our monthly services.
· If customer is still not satisfied and requests to disconnect service, General Care will transfer the call to Account Services. This is a unit at risk.
Actions :
· Use one of the following available options:
· Offer to return the customer to the original casual data or text messaging plan.
§ The plans were in effect prior to 10/1/06 with previous casual usage rate of $0.10 on text messaging and $0.02/kb on data service.

I was forced to call TWICE to India this evening because of a problem with setting up another line. Attention India idiots: pleeeeeeze speak better!!!! To hell with India!! Sprint must die!!! Need to keep my numbers so I’ll live with the pain.
So apparently the window of opportunity to get out of a sprint contract with no ETF has closed. My boyfriend has two lines with Sprint, for him and his mother, and has been trying to cancel for the past few days. He hates the service as it is, it’s a crap service, so this kind of gave him the out, or so we thought. He has called 4 times in the past few days with no luck, still stuck spending his hard earned money on the worst wireless service on the face of the planet. The first time their excuse was just oh we will grandfather your fee back to the way it was. The 2nd time he called late and got a call center in India, finally the man he spoke with was able to muster up enough English to spit out a line that Sprint had decided not to change after all and would remain at the 10 cent charge. So he called again and got a woman who told him because he had utilized the feature he had agreed to the new fees. Now my boyfriend doesn’t ever send text messages the one message she was reffering to was a text message sent by Sprint themselves to let him know his bill was ready online. The next person we spoke with, after speaking to our State’s Attourney General’s Office to make sure the actions he was taking were appropriate and that what they were doing was infact wrong, he called back, this time with me on the line with him. I work in a call center, for another wireless carrier. Now before one goes thinking we’re just mad because he isn’t able switching to the carrier I work for, which is Cingular, well don’t. I actually advised him to go with T-Mobile. Anyway, we talk to this woman and I stay silent and she is explaining well their legal team decided this was not material in the contract it was an add on. Yet another story. I told her that the last woman explained if he hadn’t gotten that text message from them, he could have gotten out, he would have been eligible to cancel without fees. This woman on the phone said that was correct, but then went on saying how he can’t cancel without fees because this was not technically a material change, it was an add on change, completely contradicting herself. I explained that I wanted to escalate the call to a supervisor, a real one not a lead rep/floor rep. She said she was a team supervisor blah blah. She then began in on how the information CBS and other new outlets had leaked misinformation and the only reason people were able to cancel is because their legal team had to work on things and figure it out. More bull, I explained that if it was misinformation and incorrect then why did our state’s attourney general’s office take it seriously and why is the state of California sueing Sprint over this to which she responded I guess they didn’t get the memo. We sat on the phone with her and another woman for 2 hours and 27 minutes. I am sure I blew their average handle time completely out of the water. Bottom line they refused to let him cancel. Their customer service is complete crap. We spent a good 30-45 mins total on hold, sometimes as long as 9 mins, without any more than a hold on a minute. Being a CSR myself, I was disgusted by their complete and utter lack of customer service. My boyfriend is filing an official complaint with our state’s attourney’s office, as well as the BBB, and looking into filing a complaint with the FCC. He will cancel in January if he isn’t out of the contract before then and will pay the early termination fee.
It is absolutely pathetic the business practices Sprint has, their service is horrible, no wonder they are the bottom of the food chain in terms of wireless carriers. I hope they are bankrupt soon.
And to Mr. Hate Sprint, you know you can port your phone numbers out to another carrier right? Well unless it’s a prepaid phone. If not you can keep you phone numbers and take them to another company, screw Sprint.
I called and it worked fine. It took over an hour, but they finally caved. Bill, you can slice and dice your argument all you want, but it is what it is. SPRINT makes the customer sign an agreement which binds them for two years. SPRINT made the decision to apply changes, not the customer. The customer rarely has recourse against a large corporation. So when the LEGAL opportunity arises, which is did here, the public has a right to proceed with canceling their contracts. Your prevailing corporate mindset and attitude here further proves my opinion of Sprint: cold and worthless. Best of luck with everyone here!

My final Sprint bill contained $360.00 of charges that are entirely fraudulent and without any merit or basis in fact whatsoever. I hereby dispute these charges.
In addition, I am filing official complaints with the FCC and the BBB because these charges contradict, in their entirety, what I was told in no uncertain terms and in numerous instances by several Sprint customer service representatives during the course of several phone calls made in late September.
I was told on my final call with Sprint that my final bill would include a credit for $93.00, including the return of my initial deposit.
In addition, these charges violate outright Sprint’s Terms and Conditions which I signed upon becoming a new subscriber.
Because I have already spent countless hours of my life on the phone with Sprint CSRs, being told one thing only to find a completely different outcome when my bill arrived, I do not wish to be contacted any further by any party about these ludicrous charges:
1. I was charged for two (2) cancellation charges for $150 and $200 respectively. This is absurd and entirely fraudulent because:
1. I only had a single Sprint line.
2. I was told numerous times and in no uncertain terms by Sprint CSRs that no cancellation fee whatsoever would be applied to my cancellation because of the October 1 increase in rates of text messaging and casual data usage, as per the Terms and Conditions. Rather, according to a Sprint CSR in Florida, my final bill would include a credit for $93 because my initial deposit would be refunded.
2. I was charged two (2) $5.00 fees for “overage relief minutes,” a service neither requested by me, nor selected by me as part of my monthly plan. These services were neither wanted nor needed, as my usage stayed well within my allotted 300 minutes per month as per my plan. (This is far from the first time random, unrequested, unnecessary services were tacked on to my plan without my consent or knowledge.)
I hereby demand the check for $93 that was promised to me the last time I spoke with Sprint, as well as written repudiation and cancellation of the above charges for my records, and an apology for this unending harassment by your company.

Yesterday my girlfriend succeeded in canceling her Sprint service without ETF, with about a year left on the contract. It probably helped that she had been with Sprint for 4 years, and she’d had problems with them before. I was surprised - she has already paid her October bill, and she has received text messages in the past couple weeks. Either the customer service rep didn’t notice, or they let it slide. It only took about 10 minutes, and there was very little hassle. They did try to offer free text messaging, but she declined.
Now I just hope her bill reflects the promises of the CS guy.

I left Sprint on Oct. 11, porting out to Verizon. I had auto bill-pay and I am now hit with a $300 ETF fee (2 lines). Am I screwed or is there still hope?
Does that little part of the contract included when they change the time from 9 pm to 7 pm for unlimited nights . I pay for unlimited nights and weekends and pay extra for it to start at 7 pm and now they have nights and weekends starting at 7pm actumatically?

I remember very well that I got family plan 49.99/month today CSR saying sir, sorry to say but you forgot you signed for 59.99/month. I signed in 12/18/06 and I kept on paying them assuming I am going over minute.
2nd last month, CSR says you can have unlimited internet for $5/month may be he was very new or there was special deal I said ok I get it, I used internet and getting bill $41 additional that I used internet 0.03/kb, on asking CSR he says no you didn’t buy any monthly internet our system doesn’t show that, I told him why don’t you listen the recorded conversation I made last month with your CSR he says sorry we do not have that, when I asked please transfer me to your Manager/Supervisor/any boss one bye one he said sorry there’s none to talk.
When I asked how much to cancel the contract earlry term fee, he replied $200 each line.
I am feeling sicko.

You have two options buddy. You can either keep calling them and demanding to take off that $41 charge off of your bill. They will eventually give up. Just keep calling and trying.

I would only have a few months left on my 2 yr contract except that I added more minutes and unknowingly automatically signed on for 2 more years- what a crock!!

Sprint is a total nightmare!!!! They will say anything to you to make you think you can not cancel. Do not let them fool you. Every time you get a dropped call or can’t hear someone or any problem at all just call in and complain or go to the regular way of getting a 50 cents call credit. Dial Star 2 and then press 3 and then 1. You don’t have to talk to anyone. I argued with them for more than two hours yesterday and two hours today. They told me all kinds of crazy things, that I would have to get a lawyer, there is nothing they can do, I am in a contract, bla bla bla, so I just kept complaining and asking to talk to someone who knows their job and asking for a manager etc. finally!!!!!!!!!!! I talked to this guy and guess what I am canceled!!! He said I don’t have any cancellation fees even though I still have one more year on my contract………. finally freedom!!!! Recently I have been on the ball wanting to get rid of Sprint. With their new text message charges I decided to give it a shot.
I called up many times saying how I do not agree with these. I gave them one more call today and the lady I spoke with was civil only after I cited the TOS where it said

I found out that somebody I had spoken with earlier added unlimited text messaging onto my account. So somebody there falsified the information so that I would appear not eligible for this cancellation.
I disputed that and got the changes made. Now for the record I have two lines under the account that have been activated for the same amount of time. I was informed that one line was eligible but the other was not. I took that blow and figured I’d dispute it when the bill came with a nice letter that’s outlined above.
Along with the unlimited text messaging that they threw onto my account without me wanting it I was also informed that I had my web access canceled that same day. I don’t know what they are doing in that call center but something is not right.
I’ll be switching over to AT&T now because of 95% of the people I talk to are on that network along with rollover. Why pay for minutes you don’t use? Roll em over to next month!!!

You can cancel your account with Sprint if you do not subscribe to a text message package and then the rates go up. It would be so helpful if you people would read your terms of agreements at the back of your user guides or read the terms of service before you sign the contract verbally or otherwise. Moreover if your cell phone breaks and you dont have service and repair and do not want to go through the warranty program that the cell phone maufact. have on their units you cannot expect to get a fee phone. If you purchase a car and do not go through the warranty program you cannot just walk into a car lot and demand a new car,,,, If you do not read your bill and then call Sprint 4 months later to dispute charges it is your fault for not taking ownership on the bills you pay, If you do not know how to read the bill and dont seek to find out how it works then you will be left ignorant and should take responsiblity for that fact. If Sprint is cancelling peoples accounts it is certainly not because they call cust care too many times to get issues resloved, Rest assured it is because some people never pay their bill, and call in every month trying to get the bill reduced. If you owned a restaurant and every day someone came in and ordered food then did not want to pay and disrupted the business and harassed employess everyday and made other customers wait because they were being disruptive ,,, wouldn’t you ask them to leave and never come back. the letters from Sprint seem to me like they were trying to be nice rather then saying go away you are unruly and no matter what we have done you are still unhappy.. so go. you cannot switch from Sprint to Nextel and then cancle under 30 days. Its the same company and when you port your number the system shows where you ported from…. Anyway when the billing goes into one computer system and the company finally amalgamates completely there will be less problems…..
Perhaps research on Coverage and actually trying the service for 30 days and then returning the phone from place of purchase with in the 30 days would help you people to find a cell phone that you like and works in your area…..
Consumer take ownership and research and stop thinking everything in life is free…….

We have been trying to cancel for months now. Go into the stores and they say our contracts are up… try to cancel on line and they keep telling us we have another year on both Sprint lines. My Husband has a Nextel line that we have no problems with. Just want to cancel these two lines. I HATE SPRINT - suggestions?
I recently deactivated my sprint phone after 2 1/2 years of service. I was on a 2 year contract and I am being charged the $150 ETF. WTF? I never agreed to any new contract at any time and I didn’t get a new phone when one was offered at the end of my contract because I would have to extend my contract for another 2 years. I’ve called customer service 10 times and have filed a protest to the billing protest address listed in the Sprint Terms and Conditions. Any suggestions?
I wish i could cancel mine, i have called customer service many times and they want me to pay a 200 dollars fee to do so, as we have 3 phone that will be a fee of 600 dollars !!
This is ridiculous, i have no reception at my house anymore, when i do get calls at the Office they get dropped withing minutes. My text messages download 50% of the times.
I wish i knew a solutionm or something i could do to cancel my contract asap, if anyone has any tip on how to do so, for the Love of god let me know.

I just wanted to add my two cents. I also can’t stand Sprint: their phone selection is terrible. They could really use a new buyer/tech developer. Thier version of a touch phone is just silly-looking. I can only blame myself for renewing a contract I will now have to pay ETFs on-I knew I had hassled too much with them but renewed anyway; what a jerk! My years of dealing with customer service with Sprint have been so annoying that I don’t think I have it in me to argue with them over their fees to get out. Can’t a class-action suit be brought against Sprint and others for f—ing people like this?
I recieved a card last week that Sprint was taking off some fees and then adding 2 new fees. It’s effective Jan 1, so I plan to tackle this as soon as possible. I want out of Sprint!
We got out of 2 phone and a data card contract this past weekend. The bill has to be higher tan the previous one showing an increase due to the change of service. Our change was 0.75 cents….TTFN Sprint.

how do i cancel w/o getting 200 to pay?
my contract doesn’t end till April 09 and i’m nt waiting that long!
what can i do or say so that i get to quit the contract w/o paying that awful fee?
+sprint has the worst service and no good phones.

hey guys, i found the real deal. called sprint and asked if it would work (the representative was very friendly). so here’s how you do it
1. call *2 on your phone
2. Ask to be switched over to Nextel (requires purchasing a nextel phone [$50-$100])
3. Within 30 days of signing up with your new Nextel contract, simply call back and cancel your account. No early termination fee’s nothing.
there ya go guys

The first CSR I spoke to gave me problems, but just be persistent. They will try to “fix” it once they realize they are cornered. Don’t let them. I only had two text-message charges, which would have cost me $0.10 more under the new rates. I told them, the amount of material losses is inconsequential to the letter of the wording. They have no argument. Period… The wording in the T&C gives Sprint no outs. It does not qualify the “material term of the Agreement” changed nor the “material adverse effect” it may cause you. This wording basically means “any.” It does not get any clearer than this. Just stick to it, stay calm, and don’t take “no” for an answer.
